This Privacy Policy describes how Dark Charms (a trading name of Tiamco Pty Ltd, ABN 17 615 757 009, "we," "us," or "our") collects, uses, and shares your personal information when you visit or make a purchase from darkcharms.co (the "Site"). It is written to meet the Australian Privacy Act 1988 and the Australian Privacy Principles, and to respect the rights of our United States customers, including California residents.

Information We Collect

When you visit the Site, we automatically collect certain information about your device, including your web browser, IP address, time zone, and some of the cookies installed on your device. As you browse the Site, we collect information about the individual web pages or products you view, the websites or search terms that referred you to the Site, and how you interact with the Site. We refer to this automatically collected information as "Device Information."

We collect Device Information using the following technologies:

  • Cookies are data files placed on your device. You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. However, if you do not accept cookies, you may not be able to use some portions of our Site.

When you make a purchase or attempt to make a purchase through the Site, we collect certain information from you, including your name, billing address, shipping address, payment information, email address, and phone number. We refer to this as "Order Information."

How We Use Your Personal Information

We use the Order Information we collect to fulfil orders placed through the Site, including processing your payment, arranging for shipping, and providing you with invoices and order confirmations. We also use this information to communicate with you, screen orders for potential risk or fraud, and provide you with information or advertising relating to our products or services where you have opted in to receive this.

We use the Device Information we collect to help us screen for potential risk and fraud, particularly your IP address, and more generally to improve and optimise our Site, for example by generating analytics about how our customers browse and interact with the Site, and to assess the success of our marketing and advertising campaigns.

Sharing Your Personal Information

We share your Personal Information with third parties to help us use your Personal Information as described above.

We use our studio and shipping partners to produce and deliver your artwork, and couriers to ship and track your order.

We use Gelato to produce and fulfil our prints. Your name, shipping address and order details are shared with Gelato and its local production partners so your print can be made and delivered in your own country.

We use Klaviyo to manage our email marketing. When you subscribe to our emails or make a purchase, your email address and related information are shared with Klaviyo.

We use Google services, including Google Analytics, Google Merchant Center and Google Ads, to measure site performance, list our products across Google, and measure advertising effectiveness. We use Meta (Facebook and Instagram), Pinterest and TikTok advertising pixels and Conversions API to measure advertising effectiveness.

We use Judge.me to collect and display product reviews. If you leave a review, your name and review content are shared with Judge.me.

We use UpPromote to run our affiliate program and attribute referred orders.

We may also share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant, or other lawful request for information we receive, or to otherwise protect our rights.

We do not sell your personal information.

Behavioural Advertising

As described above, we use your Personal Information to provide you with targeted advertisements or marketing communications we believe may be of interest to you. You can opt out of targeted advertising by visiting:

International Transfer

Because our studio partner and some of our providers operate internationally, your personal information may be processed outside your country, including outside Australia. We take reasonable steps to ensure it is handled securely and in line with this policy and the Australian Privacy Principles.

Do Not Track

Please note that we do not alter our Site's data collection and use practices when we see a Do Not Track signal from your browser.

Your Rights

You have the right to access the personal information we hold about you and to ask that it be corrected, updated, or deleted. To exercise this right, contact us using the details below.

If you are a California resident, you have specific rights under the California Consumer Privacy Act (CCPA and CPRA), including the right to know, the right to delete, and the right to opt out of the sale of personal information. We do not sell your personal information.

Data Retention

When you place an order through the Site, we will retain your Order Information for our records and to meet our legal and tax obligations, unless and until you ask us to delete this information and we are no longer required to keep it.

Minors

The Site is not intended for individuals under the age of 16. We do not knowingly collect personal information from children under 16.

Changes

We may update this Privacy Policy from time to time in order to reflect changes to our practices or for other operational, legal, or regulatory reasons.
